We are a credit representative of Finance and Systems Technology Pty Ltd (ACN 092 660 912, Credit Representative Number 392527).

This Finance Privacy Policy explains how we collect, hold, use, and disclose your personal and credit-related information when you engage us for credit assistance services. We are bound by the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and Part IIIA of the Privacy Act which deals specifically with credit reporting.

By engaging our credit assistance services, you acknowledge that you have read and understood this policy.

2. What Personal Information We Collect

In the course of providing credit assistance, we may collect the following types of personal information:

Identity and Contact Information

  • Full name, date of birth, gender, and marital status
  • Residential address, postal address, email address, and phone numbers
  • Proof of identity documents such as driver's licence, passport, or Medicare card
  • Residency and citizenship status

Financial Information

  • Employment details, including employer name, position, length of employment, and employment type
  • Income details, including salary, rental income, investment income, government benefits, and self-employment income
  • Details of assets, including real property, vehicles, savings, superannuation, and investments
  • Details of liabilities, including existing loans, credit cards, HECS/HELP debts, and other financial obligations
  • Bank statements, payslips, tax returns, financial statements, and Notices of Assessment

  • Details of the finance products you enquire about or apply for
  • Property details for secured lending, including property valuations and contracts of sale
  • Details of vehicles or equipment for asset finance applications
  • Business financial information for commercial lending applications

3. How We Collect Your Information

We collect personal information through a variety of means, including:

  • Directly from you, through application forms, fact-find questionnaires, phone calls, emails, video calls, and in-person meetings
  • From documents you provide, such as payslips, bank statements, identification documents, and tax returns
  • From third parties with your consent, including credit reporting bodies, lenders, real estate agents, solicitors, conveyancers, accountants, and other professionals acting on your behalf
  • From our broker group, Finance and Systems Technology Pty Ltd, in connection with the processing of your loan application
  • From publicly available sources where necessary and lawful

Where practicable, we will collect personal information directly from you. If we receive unsolicited personal information about you that we did not request, we will determine whether we could have lawfully collected it. If not, we will destroy or de-identify the information as soon as practicable.

4. How We Use Your Information

We use your personal and credit-related information for the following purposes:

  • To assess your financial situation, requirements, and objectives in order to identify suitable finance products
  • To prepare, submit, and manage loan applications with lenders on your behalf
  • To comply with our responsible lending obligations under the National Consumer Credit Protection Act 2009 (Cth), including conducting preliminary assessments of suitability
  • To comply with the Best Interests Duty for consumer credit assistance
  • To communicate with you about your enquiry, application, or existing finance arrangements
  • To obtain and verify credit reports and credit information as part of the application process
  • To comply with our legal and regulatory obligations, including anti-money laundering and counter-terrorism financing requirements under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)
  • To manage complaints, disputes, or legal proceedings
  • To conduct periodic reviews of your existing finance arrangements
  • With your consent, to provide you with information about products and services that may be of interest to you

5. Disclosure of Your Information

In the course of providing credit assistance, we may disclose your personal and credit-related information to the following types of recipients:

  • Lenders and financial institutions on our panel for the purpose of processing and assessing your loan application
  • Our broker group, Finance and Systems Technology Pty Ltd (ACN 092 660 912), as required for loan submission, compliance, and management
  • Credit reporting bodies such as Equifax, Experian, and illion, to obtain your credit report or to update credit information
  • Lenders' mortgage insurers (LMI providers) where mortgage insurance is required for your loan
  • Professional advisers including solicitors, conveyancers, accountants, valuers, and other professionals involved in your transaction
  • Government and regulatory bodies where required by law, including ASIC, AUSTRAC, and the Australian Taxation Office
  • External dispute resolution bodies such as the Australian Financial Complaints Authority (AFCA) in connection with any complaint
  • Service providers who assist us in delivering our services, including IT providers, CRM platforms, and document management systems

We will not sell, rent, or trade your personal information to any third party for marketing purposes. We take reasonable steps to ensure that any third party to whom we disclose your information is bound by privacy obligations consistent with the APPs.

6. Credit Reporting

We handle credit-related information in accordance with Part IIIA of the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code 2014 (Version 2.1).

When you apply for credit through us, we may:

  • Access your credit report from one or more credit reporting bodies to assess your creditworthiness
  • Disclose credit-related information to lenders as part of the loan application process
  • Use credit eligibility information to determine your eligibility for particular loan products

You have the right to request access to the credit information these bodies hold about you. You may also request a temporary ban on credit reporting body use of your credit report if you believe you have been, or are likely to be, a victim of fraud.

7. Data Security

We take the security of your personal information seriously and implement reasonable physical, electronic, and organisational safeguards to protect it from misuse, interference, loss, unauthorised access, modification, or disclosure. These measures include:

  • Secure storage of physical documents in locked premises with restricted access
  • Encryption of electronic data in transit and at rest
  • Access controls and authentication measures for our systems and databases
  • Regular security reviews and staff training on privacy and data handling obligations
  • Secure destruction or de-identification of personal information that is no longer required for any purpose for which it may lawfully be used or disclosed

While we take all reasonable precautions, no method of data transmission or storage is completely secure. We cannot guarantee the absolute security of your information. In the event of a data breach that is likely to result in serious harm, we will comply with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth).

8. Access and Correction

Under the Australian Privacy Principles, you have the right to:

  • Request access to the personal information we hold about you
  • Request correction of any information that is inaccurate, out of date, incomplete, irrelevant, or misleading
  • Request details about how your personal information has been used or disclosed

To make an access or correction request, please contact us using the details in Section 11 below. We will respond to your request within 30 days. We may charge a reasonable fee for providing access to your information where permitted by law.

There may be limited circumstances where we are unable to provide access, such as where the information relates to existing or anticipated legal proceedings, or where providing access would unreasonably impact the privacy of others. If we refuse your request, we will provide written reasons.

9. Direct Marketing

We may use your personal information to send you marketing communications about finance products and services that may be relevant to you. We will only do so where you have consented or where we reasonably believe you would expect to receive such communications.

You can opt out of receiving marketing communications at any time by contacting us or using the unsubscribe function in any electronic communication. We will process your opt-out request promptly and at no cost to you. Please note that opting out of marketing communications will not affect communications that are necessary for the ongoing management of your finance arrangements.

10. Complaints

If you believe we have breached your privacy or mishandled your personal information, you have the right to lodge a complaint. We take all complaints seriously and will investigate them promptly.

Internal Complaint Process

In the first instance, please contact our Privacy Officer using the details in Section 11 below. We will acknowledge your complaint within five business days and aim to resolve it within 30 calendar days. If we need more time, we will let you know and keep you informed of our progress.
